Bunlardandolay\u0131, hak lehtar\u0131 veya \u00fc\u00e7\u00fcnc\u00fc ki\u015filerce \u00fcst hakk\u0131ndan kaynaklanan herhangibir hak veya talepte bulunulamaz. S\u00f6zle\u015fmenin fesih tarihinde i\u015flerin mevcutdurumu, idarece g\u00f6revlendirilecek bir heyet taraf\u0131ndan y\u00fcklenici veya vekiliile birlikte tespit edilerek bir durum tespit tutana\u011f\u0131 d\u00fczenlenir.<\/p>\n<ul>\n<li>T\u00fcrk ceza muhakemesi hukukunda \u015f\u00fcpheli\/san\u0131\u011fa y\u00fcklenen su\u00e7hakk\u0131nda A\u00e7\u0131klamada bulunmamas\u0131n\u0131n kanun\u00ee hakk\u0131 oldu\u011fu, hem soru\u015fturmaa\u015famas\u0131nda if\u00e2de \u00f6ncesi hem de kovu\u015fturma a\u015famas\u0131nda Duru\u015fmaya ba\u015flama s\u0131ras\u0131ndabildirilmek mecbur\u00eeyetindedir.<\/li>\n<li>Bu a\u00e7\u0131dan kanun koyucunun mahkemenin yarg\u0131 yetkisinikullan\u0131rken yani ba\u011f\u0131ms\u0131z olarak vicdani kanaatine g\u00f6re h\u00fck\u00fcm verirken bunam\u00fcdahale etmek suretiyle takdir yetkisini kald\u0131rmas\u0131 ya da k\u0131s\u0131tlamas\u0131, yarg\u0131yetkisinin kullan\u0131lmas\u0131na ve mahkemenin ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131na m\u00fcdahale edilmesisonucunu do\u011furur.<\/li>\n<li>\u201c(1)\u00a0Ola\u011fan\u00fcst\u00fchaller ve do\u011fal afetlerin i\u015fyerlerinde ve yap\u0131lan i\u015flerde meydana getirece\u011fihasar ve zararlar ile sigortalanabilir riskler (all risk) sigorta kapsam\u0131ndabulundu\u011fundan y\u00fcklenici, bu hasar ve zararlar i\u00e7in idareden hi\u00e7 bir bedelisteyemez.<\/li>\n<\/ul>\n<p>Bua\u015famadan sonra d\u00fczenlemenin nas\u0131l i\u015fleyece\u011fi hususu ise maddenin be\u015fincif\u0131kras\u0131nda a\u00e7\u0131klanm\u0131\u015ft\u0131r. Buna g\u00f6re, eri\u015fimin engellenmesini talep edenki\u015filer, internet ortam\u0131nda yap\u0131lan yay\u0131n i\u00e7eri\u011fi nedeniyle \u00f6zel hayat\u0131ngizlili\u011finin ihl\u00e2l edildi\u011finden bahisle eri\u015fimin engellenmesi talebini taleptebulundu\u011fu saatten itibaren yirmi d\u00f6rt saat i\u00e7inde sulh ceza h\u00e2kiminin karar\u0131nasunar. H\u00e2kim, internet ortam\u0131nda yap\u0131lan yay\u0131n i\u00e7eri\u011fi nedeniyle \u00f6zel hayat\u0131ngizlili\u011finin ihl\u00e2l edilip edilmedi\u011fini de\u011ferlendirerek verece\u011fi karar\u0131n\u0131 en ge\u00e7k\u0131rk sekiz saat i\u00e7inde a\u00e7\u0131klar ve do\u011frudan Ba\u015fkanl\u0131\u011fa g\u00f6nderir; aksi h\u00e2lde,eri\u015fimin engellenmesi tedbiri kendili\u011finden kalkar denilmi\u015ftir. Yasakoyucu, yasaman\u0131n genelli\u011fi ilkesigere\u011fince kendine tan\u0131nan takdir yetkisi ba\u011flam\u0131nda diledi\u011fi yasaltasarruflarda bulunabilir. Ancak, Anayasal kurallara, sosyal hukuk devletiilkelerine ve hukukun temel prensiplerine uymakla y\u00fck\u00fcml\u00fcd\u00fcr. Kanunlar\u0131n,kamu yarar\u0131 amac\u0131na y\u00f6nelik olmas\u0131, genel, objektif,adil kurallar i\u00e7ermesi ve hakkaniyeti g\u00f6zetmesi hukuk devleti olman\u0131ngere\u011fidir. Bu nedenle, yasakoyucunun hukuki d\u00fczenlemelerde kendisine tan\u0131nantakdir yetkisini anayasal s\u0131n\u0131rlar i\u00e7inde adalet, hakkaniyet ve kamu yarar\u0131\u00f6l\u00e7\u00fctlerini g\u00f6z \u00f6n\u00fcnde tutarak kullanmas\u0131 gerekir.<\/p>\n<p>Askeri mahkeme ve askeri savc\u0131l\u0131k kadrolar\u0131nda g\u00f6rev yapmakta olan ve mesleki sicilleri bulunmayan askeri hakimlerin o sicil y\u0131l\u0131 i\u00e7in kademe ilerlemelerinde sicil \u015fart\u0131 aranmaz. Soru\u015fturma evresi, s\u00f6z konusu Kanun\u2019un2. Maddesinde \u201c\u2026yetkili mercilerce su\u00e7 \u015f\u00fcphesinin \u00f6\u011frenilmesindeniddianamenin kabul\u00fcne kadar ge\u00e7en evre\u2026\u201d olarak tan\u0131mlanm\u0131\u015ft\u0131r. Buitibarla seri muhakeme usul\u00fc ancak soru\u015fturma evresinin sonunda ve kamu davas\u0131a\u00e7maya yeterli \u015f\u00fcphe elde edildi\u011fi durumda uygulanabilecektir. (9) Mahkeme, \u015f\u00fcpheliyi m\u00fcdafii huzurunda dinlediktensonra \u00fc\u00e7\u00fcnc\u00fc f\u0131kradaki \u015fartlar\u0131n ger\u00e7ekle\u015fti\u011fi, eylemin seri muhakeme usul\u00fckapsam\u0131nda oldu\u011fu ve dosyadaki mevcut delillere g\u00f6re mahk\u00fbmiyet karar\u0131verilmesi gerekti\u011fi kanaatine var\u0131rsa talep yaz\u0131s\u0131nda belirtilen yapt\u0131r\u0131mdandaha a\u011f\u0131r olmamak \u00fczere d\u00f6rt ila yedinci f\u0131kra h\u00fck\u00fcmleri do\u011frultusunda h\u00fck\u00fcmkurar; aksi takdirde talebi reddeder ve soru\u015fturman\u0131n genel h\u00fck\u00fcmlere g\u00f6resonu\u00e7land\u0131r\u0131lmas\u0131 amac\u0131yla dosyay\u0131 Cumhuriyet ba\u015fsavc\u0131l\u0131\u011f\u0131na g\u00f6nderir. Mazeretsizolarak mahkemeye gelmeyen \u015f\u00fcpheli, bu usulden vazge\u00e7mi\u015f say\u0131l\u0131r.<\/p>\n<p>6428 say\u0131l\u0131 Kanunla, Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131 ve ba\u011fl\u0131 kurulu\u015flar\u0131ncayap\u0131lmas\u0131na ihtiya\u00e7 duyulan tesislerin \u00f6n proje, \u00f6n fizibilite raporu vebelirlenecek temel standartlara dayal\u0131 olarak ihale edilmesi ve kamu-\u00f6zeli\u015fbirli\u011fi modeli \u00e7er\u00e7evesinde \u00f6zel hukuk h\u00fck\u00fcmlerine g\u00f6re yapt\u0131r\u0131lmas\u0131d\u00fczenlenmektedir. Devlete Anayasa ile verilmi\u015f ormanlar\u0131nkorunmas\u0131 ve orman alanlar\u0131n\u0131n geni\u015fletilmesi g\u00f6revi, ormanl\u0131k alanlarda yap\u0131lacakkamu hizmetleri ile kamu yarar\u0131 ama\u00e7l\u0131 yat\u0131r\u0131mlar\u0131n gerektirdi\u011fi irtifakhakk\u0131na dayal\u0131 izin tasarruflar\u0131ndan, izne konu olu\u015fturan hizmet ve yat\u0131r\u0131m\u0131nniteli\u011fi ve kamu yarar\u0131 ile ili\u015fkisine g\u00f6re \u201cA\u011fa\u00e7land\u0131rmabedeli\u201d, \u201cA\u011fa\u00e7land\u0131rma ve erozyon kontrol\u00fc geliri\u201d ve \u201cArazi izin bedeli\u201dndenbir ya da birka\u00e7\u0131n\u0131n al\u0131nmas\u0131n\u0131 gerektirmektedir. Devletin yerle\u015fim yerleri aras\u0131nda ula\u015f\u0131m\u0131sa\u011flamak amac\u0131yla yapaca\u011f\u0131\/yapt\u0131raca\u011f\u0131 eri\u015fme kontroll\u00fc karayolu g\u00fczergah\u0131n\u0131norman alanlar\u0131ndan ge\u00e7mesi durumunda, gerekli izinlerin verilmesi gerekece\u011findekamu yarar\u0131 oldu\u011fu ku\u015fkusuzdur\\. Bu suretle askeri hakim ve askeri savc\u0131 yard\u0131mc\u0131l\u0131\u011f\u0131 adayl\u0131\u011f\u0131na ayr\u0131lm\u0131\u015f olanlar, askeri mahkemelerde ve askeri savc\u0131l\u0131klarda \u00fc\u00e7 ay \u00e7al\u0131\u015ft\u0131r\u0131l\u0131rlar. Bu s\u00fcre sonunda ba\u015far\u0131 g\u00f6sterenlerin askeri hakim yard\u0131mc\u0131l\u0131\u011f\u0131na veya askeri savc\u0131 yard\u0131mc\u0131l\u0131\u011f\u0131na 16 nc\u0131 madde h\u00fck\u00fcmlerine uygun olarak atanmalar\u0131 yap\u0131l\u0131r ve bunlar askeri hakim ve askeri savc\u0131 yard\u0131mc\u0131lar\u0131n\u0131n haklar\u0131na ve yetkilerine sahip olurlar. Ba\u015far\u0131 g\u00f6steremiyenler veya askeri hakim veya askeri savc\u0131 yard\u0131mc\u0131s\u0131 olmak niteliklerini kaybedenler Milli Savunma Bakanl\u0131\u011f\u0131 taraf\u0131ndan derhal as\u0131l s\u0131n\u0131flar\u0131na g\u00f6nderilirler.
